In fact he has retired on superannuation on 30.06.2021.

Learned Advocate for the petitioner relied upon a judgement reported in (2007) 15 SCC 553 in support of the case of the petitioner submitting his representation first given in 1988 (vide page 46) and also given thereafter have never been considered. On perusal of the said judgement, I found that the factual matrix of the said judgement has no resemblance in the present case. It is found that the petitioner has approached this Court different times with other grievances but he never came to this Court for correction of his date of birth. His representation for correction of date of birth was neither

considered nor he was directed by any authority to submit further documents for considering his case.

Learned Advocate for the respondent authority submitted that the petitioner used several concocted and manufactured documents which allegation I need not go through.

After hearing the petitioner, I expressed my mind and wanted to know from the petitioner considering the ingenuity of the writ application, whether the petitioner is willing to withdraw this case on his own or whether this Court will pass an order of dismissal with exemplary cost for such a frivolous application. The petitioner is present physically before the Court along with his learned Advocate. After taking instructions in front of the Court from the client the learned Advocate, Mr. Bhattacharya has withdrawn this case.

This writ application is dismissed as withdrawn. (Abhijit Gangopadhyay, J.)
