The petitioner who at the relevant point of time was working as Assistant Teacher at Monber Vivekananda Vidyapith, District- Hooghly during the period from September 4, 2009 till April 16, 2015. The petitioner has not yet received her provident fund dues.

Referring to the annexure P-3 at pages- 23 to 26, Mr. Ekramul Bari, learned Counsel for the petitioner submits that at the relevant point of time, the respondent no.4 all along has communicated the respondent no.6 and/or the school authority to transmit the relevant records and papers before it so that necessary payments on account of provident fund could be released in favour of the petitioner. The records show nothing was done by the respondent no.6 and/or the school authority.

Today when the writ petition was taken up for consideration, none appears for the respondents. In view of the above, the respondent no.6 is directed to send all papers, records and documents relating to the petitioner before the respondent no. 4 positively within a

period of 10 days from the date of communication of this order.

The respondent no.4 then shall bring it to the notice of the respondent no.3 forthwith and the respondent no.3 shall take all necessary and consequential steps to clear the provident fund dues of the petitioner and shall communicate all other necessary authorities for disbursement of payment in favour of the petition forthwith.

The entire exercise as directed above shall be carried out by the respondent no.4 and the respondent no.3 respectively positively within a period of four weeks from the date of receiving the documents and records from the school authority.

Since affidavits are not called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.

On the above terms, this writ petition WPA 6707 of 2018 stands disposed of, without any order as to costs. Parties shall act in terms of the copy of the order downloaded from the official website of this Court. (Aniruddha Roy, J.)
