Ms. Bina Baidya .....for the petitioner This is an application seeking expeditious disposal of a proceeding of a Complaint Case under Section 138 of the Negotiable Instrument Act.
Affidavit of service filed on behalf of the petitioner is taken on record.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner initiated the proceeding under Section 138 of the Negotiable Instrument Act way back in 2019. After that, several dates were fixed. Some long dates were also fixed in the case. The accused only took bail and on some occasions prayed for time. The present proceeding has remained pending for no fault of the present petitioner.
I have heard the submissions of the learned counsel appearing on behalf of the petitioner and perused the revision petition.
No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.
It is true that Covid-19 pandemic had intervened in the meantime.
However, since the proceeding was started in 2019
under Section 138 of the Negotiable Instrument Act, it goes without saying that some delay has been occasioned in concluding the same.
In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of six months from next date of hearing.
With these observations, the revisional application is disposed of.
