04 14.08.2023 NB Ct. 14 WPA 8246 of 2023 Prafulla Ghosh Vs.

The State of West Bengal & Ors.

Mr. Sandipan Maity, Mr. Rajkumar Sain.

...for the petitioner.

Mr. Anand Farmania, Ms. Indumouli Banerjee.

....for the State.

Mr. Tapan Dutta Gupta, Mr. Parvej Anam.

...for the private respondent.

This is an application under Article 226 of the Constitution of India praying for a direction upon the respondent authorities to undertake appropriate measures for recovery of the minor daughter of the petitioner and investigate the FIR being Ketugram Police Station Case No.93 of 2023 dated 10.02.2023 properly and in accordance with law. Since the case subsequently involved provisions of the POCSO Act and the victim was a minor girl, appropriate directions were passed by this Court on 09.08.2023 upon the petitioner and others to hide the identity of the victim girl from the writ petition and from anything connected to the same. It appears that the same has been substantially complied with. From the report of the State, it appears that the minor girl has already been recovered. She has been kept in a home and her statement has also been recorded.

Let the report dated 12.04.2023 filed by the State along with its annexures be kept with the records in a sealed cover.

Learned counsels appearing on behalf of the petitioner, private respondent and the State are represented. Heard the learned counsels.

Since the prime grievance of the petitioner has already been redressed and the girl has been recovered, no further order need be passed in this case.

Accordingly, the writ petition is disposed of without any costs.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
