In Re: CAN 1 of 2025

1. Modification is sought of this Court's order dated 16th January, 2023, by Ms. Damayanti Sen who was appointed to reinvestigate the matter after forming a team of police officers of her own. Ms. Sen has indicated that she is in indifferent health and is unable to undertake the investigation any longer. In those circumstances, let Ms. Damayanti Sen be replaced by Mr. Murlidhar Sharma, IGP, Director of Swami Vivekananda State Police Academy.

2. The directions contained in this Court's order dated 16th January, 2023 shall apply mutatis and mutandis to the replaced IPS officer.

3. Ms. Sen shall hand over all the papers towards investigation to the newly appointed officer Mr. Murlidhar Sharma.

4. It is submitted by Mr. Chatterjee, learned counsel for the original writ petitioner that a new writ petition being WPA 3697 of 2025 has been filed in respect of the subject matter of the said writ petition being WPA 6715 of 2018.

5. It is made clear that apart from changing the name of the principal investigating officer, this Court has not entered into the merits of the grievances of the writ petitioner as regards the investigation itself.

6. CAN 1 of 2025 shall stand disposed of.

7. There shall be no order as to costs.

8. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
