... for the State Mr. Arindam Ray, learned Advocate appearing for the petitioner submits that the petitioner is innocent in nature. The petitioner has been mostly implicated in the present case. Other co-accused have already been granted anticipatory bail. Therefore, the petitioner should be granted anticipatory bail.

Mr. Bidyut Kumar Ray, learned Advocate appearing for the State opposes the prayer for anticipatory bail and produces the Case Diary. Mr. Ray initially submits that Romen Ghosh @ Ramkrishna Ghosh was granted anticipatory bail but since he failed to comply with the conditions, therefore, his application for bail was rejected and warrant of arrest was issued. Till date he has not surrendered. That being the scenario, we are in the considered view that the petitioner should not be granted anticipatory bail.
