Rajib Bhadra v. State Of West Bengal
Sr.20 26-08-2021 Subha.
Court no. 34
IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1180 of 2012 In the matter of : Rajib Bhadra .....petitioner. In Re : An application under Section 482 of the Code of Criminal Procedure.
Mr. Arijit Ganguly, Mr. Sandip Chakrabroty .......for the State.
As none appears on behalf of the petitioner or for the State, Mr. Sandip Chakrabroty, learned advocate who ordinarily appears for the State is directed to appear in this matter along with Mr. Arijit Ganguly, learned advocate. Their appointments may be regularized by the concerned authorities in due course.
Mr. Chakrabroty, learned advocate for the State draws the attention of this court to the fact that 11 cases have been clubbed in a single application under Section 482 of the Code of Criminal Procedure with a prayer for Investigating Agency to conduct a single investigation.
Having regard to the settled proposition of law that if the investigating agency has legally invoked the jurisdiction to register cases in respect of separate cause of action, it would not be fit and proper for the court to interfere. Further, under Section 482 of the Code of Criminal Procedure it is not possible for the court to decide in respect of all eleven police station cases in a single application.
In view of the aforesaid, I am of the opinion that no interference is called for.
Accordingly, the revisional application being CRR 1180 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
