The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with. The petitioner under Section 25 of the Guardians and Wards Act, 1890 has applied for custody of her minor son. The said application has been registered as Misc. Case no. 53 of 2017, pending before the 1st Court of learned Additional District Judge, Howrah.

The petitioner is complaining delay in disposal of the said Misc. Case.

The learned Trial Judge is requested to expedite the disposal of the Misc. Case no. 53 of 2017 in accordance with law, if the same is otherwise ready for such disposal, and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 1112 of 2024 is thus disposed of without any order as to costs.

The petitioner shall communicate this order to the opposite party.
