Court no. 34

IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1195 of 2012 In the matter of : Dr. Ujjal Kumar Chatterjee .....petitioner. In Re : An application under Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the proceedings relating to C.R. Case No. 626 of 2011 as also the order dated 20th December, 2011 passed by the learned Judicial Magistrate, 2nd court, Suri. The order dated 27th February, 2011 reflects that the learned Magistrate has categorically observed that the provisions of review are not available to the learned Magistrate and as such rejected such application so preferred. Having regard to the observation made by the learned Magistrate, I am of the view that the provisions of Section 362 of the Code of Criminal Procedure have been adhered to by the learned court and as such no interference is called for.

Accordingly, the revisional application being CRR 1195 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
