(Via Video Conference) Mr. Angshuman Chakraborty, Mr. Shivaji Mitra ...for the petitioner Mr. Lalit Mohan Mahata, Mr. Kapil Guha ...for the State Affidavit of service filed in Court today is taken on record.

The writ petitioner is the lawfully wedded wife of the private respondent no.4. She separated from her husband and the two children born out of their wedlock are presently residing with her. Proceedings under Section 498A of the IPC has been initiated, which has resulted in charge sheet being No. 379/2020 dated 26.11.2020 under Sections 341/354B/498A/406/307/504/120B/34 of the Indian Penal Code.

The petitioner further submits that the list of documents relating to herself and her two children are lying in the custody of the private respondent no.4.

Subject to any decision as regards the custody by any Court of competent jurisdiction, let the Passport, Aadhar Card, LIC documents, Birth

Certificate of the two children and the petitioner be recovered by the Officer-in-Charge, Chinsurah Police Station and handed over against accountable receipt to the writ petitioner.

It is clarified that the documents shall be retained by the petitioner, subject to any order that may be passed by any Court of competent jurisdiction in future.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
