(NDPS) 442 of 2025 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Contai Police Station Case No. 475/2024 corresponding to T.R.(NDPS) Case No. 10/2024 dated 23.07.2024 under Section 20 (b) (ii) (c) of the NDPS Act, 1985.

And In the matter of : Tapas Maity .... Petitioner Mr. Rabiul Islam Mr. Sk. Jayeel Hossain Ms. Afreen Begum ...for the Petitioner Mr. Ranadeb Sengupta Mr. Rajashree Tah ...for the State It is submitted on behalf of the petitioner that from the seizure list, it appears that about 1kg of Ganja approximately in twenty packets containing total 20kg of Ganja recovered from the joint possession of Tapas Maity & Sk. Sirajul. However, in the forwarding report it has been mentioned that 20kg 800grm of Ganja was recovered which clearly mismatches with the seizure list. He further submits that he is custody for about one year and though charge-sheet submitted but charge has not yet been framed and, as such, nobody knows when the trial would be concluded. Accordingly, he prays for bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposes the prayer contending that the statutory restrictions attracts in the present case and trial is about to start within a short span of time.

Having heard the learned counsel appearing on behalf of the petitioner and the State and that rigours of Section 37 of the NDPS Act attracts in the present case, the prayer for bail is considered and rejected.

However, learned Trial Court is requested to expedite hearing of the case and to conclude the entire proceeding within a shortest possible period.

Accordingly, CRM (NDPS) 442 of 2025 is disposed of. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
