08.04.2024 Sl. No.31 akd [Rejected] C. R. M. (DB) 984 of 2024 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 22.03.2024 in connection with Keshiary Police Station Case No.14 of 2024 dated 19.01.2024 under Sections 417/376(2)(n)/323/313/509/34 of the Indian Penal Code. (G.R. Case No.38 of 2024) And In Re: Ajay Mukhi ... ... Petitioner Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha ... ... for the petitioner Ms. Zareen N. Khan ... ... for the de-facto complainant Mr. Antarikhya Basu Ms. Madhumita Basak ... ... for the State

1. It is submitted on behalf of the petitioner that he is in custody for about 80 days. It is further submitted there was a romantic relationship between the parties. Accordingly, he prays for bail.

2. Learned Advocate for the State opposes the prayer for bail.

3. Learned Advocate for the de-facto complainant/victim also opposes the prayer for bail.

4. We have considered the materials on record. Though it appears there was a romantic relationship between two young persons, we note petitioner had forced the victim to undergo incomplete abortion. This adversely impacted the health of the victim. Victim is yet to be examined. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

5. The application for bail is thus rejected. (Prasenjit Biswas, J.) (Joymalya Bagchi, J.) Signed By :
