In view of the express undertaking of the petitioner to comply with all the formalities regarding filing including stamping of the petition immediately upon resumption of normal Court business and in view of the urgency pleaded, the application, being IA No.: CAN 1 of 2020 [Old no.: CAN 4477 of 2020], is allowed and the writ petition is taken up for hearing.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that the respondents have not disbursed the subsistence allowance of the petitioner till date though he had been suspended in the month of August, 2019 vide memo dated 19th August, 2019. Aggrieved thereby, the petitioner had approached this Court.

Mr. Basu Mallick, learned advocate appearing for the Council submits that steps are being taken towards disbursement of the subsistence allowance in favour of the petitioner. Mr. Vaisya, learned advocate appears for the State.

Upon hearing the learned advocates appearing for the respective parties and upon considering the materials on record, the writ petition is disposed of directing the respondents to disburse the subsistence allowance of the petitioner within a period of two weeks from the date of communication of this order, subject to compliance of necessary formalities, if any, by the petitioner.

There shall, however, be no order as to costs.

All concerned parties shall act in terms of the copy of the order downloaded from the official website of this court.
