Case No.85 of 2024 dated 30.09.2024 under Sections 85/115(2)/109/3(5) of the BNS, 2023 R/W Section 3/4 of the D.P. Act, 1961 and Section 4 of the Muslim Women Protection of Rights on Marriage Act, 2019.

Ms. Baisali Basu Mr. Ratul Ghosh ... for the State Learned counsel appearing for the petitioner submits as follows. The petitioner is the father-in-law of the de facto complainant/victim. The couple stayed elsewhere in a rented accommodation. The prime accused in this case is the husband. The mother-in-law and the sister-in-law were granted anticipatory bail by the Sessions Court. Learned counsel for the State opposes the prayer for anticipatory bail and submits that apparently the husband of the victim is the main accused. However, there are allegations against all other accused.

Considering the materials available in the case diary, especially the role ascribed to the petitioner, I do not think

that custodial interrogation of the petitioner is required in this case.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall meet the investigating officer of the case once a fortnight till submission of report in final form and the petitioner shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, allowed. (Jay Sengupta, J.)
