Mr. Rabi, learned advocate appearing for the appellants submits that the appellant no. 1, namely, Ganesh Chandra Karmakar expired on 17th May, 2017 and as such to bring on record the legal heirs of the said appellant, who are all major and sui juris, the present application for substitution has been filed within time. Mr. Panja, learned advocate enters appearance on behalf of the respondent.
Upon hearing the learned advocates appearing for the respective parties and upon considering the materials on record, the application for substitution being CAN 1 of 2021 which has been filed by the appellant no. 2 within time, is allowed directing substitution of the names of the
heirs as mentioned in paragraph 1 of the instant application in the place of the deceased, namely, Ganesh Chandra Karmakar.
Office is directed to effect necessary correction in the cause title of the appeal.
The application being CAN 1 of 2021 is, accordingly, disposed of.
