Mr. Rittick Chowdhury Mr. Samaresh Chandra Dhara ...for the petitioner The petitioners have challenged the orders dated June 5, 2010 and July 16, 2011 passed by the learned Civil Judge (Jr. Div.), 1st Court at Tamluk in Title Execution Case No.1 of 2007.
By the order dated July 16, 2011, the execution case was allowed ex parte and the judgment debtors/petitioners herein were found guilty of disobeying the judgment and decree of the Court and were liable to suffer civil imprisonment for a period of one month.
The instant application under Article 227 of the Constitution of India has been filed almost after more than 13 years after the impugned orders were passed. The delay is inordinate and unexplained.
For such reason this Court is not inclined to entertain this application under Article 227 of the Constitution of India.
Accordingly, CO 1274 of 2025 stands dismissed. There will be no order as to costs.
