Rakib CRM (NDPS) 670 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Malda Police Station case no. 785 of 2025 dated 09.11.2025 under Sections 21(c)/22(c)/23(c)/27A of the NDPS Act.

Learned advocate appearing for the petitioner prays for an accommodation.

Subject matter of the case relate to alleged recovery of 26 bottles of codeine mixtures and the such recovery was from a coaccused. Petitioner has been implicated in the present case on the basis of statement of co-accused, as such, petitioner is in custody for 62 days he may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that there are two criminal antecedents one of which is under the NDPS Act.

I find that another accused has been released on bail. The only factum for which the State opposes the prayer for bail is the period of custody of the petitioner as the petitioner has been evading the process of law.

Having considered the period of detention of the present petitioner, the stage of the case, I direct the learned trial Court to release the petitioner on bail after the stage of consideration of charges are completed by the learned trial Court. To that effect learned trial Court will impose conditions as he deems fit and proper for further appearance before the learned Special Court. With the aforesaid observations CRM (NDPS) No. 670 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
