The petitioner seeks parity with co-accused who has been granted bail earlier. The petitioner is in custody for more than three years. Five out of thirty-four witnesses have been examined till date. Chances of conclusion of trial in near future is bleak. Since co-accused similarly circumstanced with the petitioner has been granted bail earlier, the petitioner is entitled to the same benefit.
Accordingly, the prayer for bail is allowed.
The petitioner namely Monoharan Mondal @ Rittik be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, subject to the condition that he shall remain within the jurisdiction of Baguiati police station except for the purpose of appearing before the learned trial Court on every date of hearing fixed by the learned Court and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
