Learned advocate appearing for the petitioner files affidavit of service and in spite of service, none appears on behalf of the respondent income tax authority.

Mr. Vipul Kundalia, learned advocate who is present in Court and who generally represents on behalf of the respondent income tax authority is directed to appear in this matter. Let a copy of this writ petition be handed over to Mr. Kundalia. The concerned department is directed to regularise the appointment of Mr. Kundalia in the instant matter.

By this writ petition, petitioner has made a very innocuous prayer for direction upon the CIT (Appeals) concerned to consider and dispose of the pending appeal which has been filed on 7th April, 2022 as appears from page 32 of the writ petition.

Considering the facts and circumstances of this case, this writ petition being WPA 8274 of 2023 is disposed of by directing the respondent CIT (Appeals) concerned to consider and dispose of the pending appeal in question filed by the petitioner expeditiously and preferably within four months from the date of communication of this order.
