Kanai Lal Das v. State Of West Bengal & ORS
05.10.2020 Item No.9 Ct. No.10 Kaushik/CHC W.P.A.6190 of 2020 CAN 1 of 2020 (Old No.C.A.N.4512 of 2020) (Via Video Conference) r Kanai Lal Das & ors.
Vs.
The State of West Bengal & ors.
Nobody is appearing for either of the parties. On a reading of the petition it is found some allegations have been made against some private persons by the petitioners as they promised to make a provision for his appointment as a primary school teacher against a sum of rupees 13 lakhs.
I hold that even if the petitioners appeared in this matter as also the respondents, the facts of the matter could not have been improved by making submissions from the bar as this is a matter which clearly comes within the penal law of the land and as also the civil law of the land. The writ court cannot be moved with such type of application and I restrain myself from exercising the jurisdiction of Writ Court in respect of this matter.
The matter is dismissed and the application being CAN 1 of 2020 (Old No. CAN 4512 of 2020) is disposed of.
However, it is made clear that the other ways are open to the petitioners for taking steps against the persons against whom they made allegation.
