AGP Mr. Diptendu Narayan Banerjee ... for the State-respondent(s) The petitioners are aggrieved by the fact that in spite of an information dated 27.03.2025 furnished with the Ghatal Police Station, no steps have been taken.

State has submitted a report which reflects that the dispute complained of refers to the fact that out of 1.25 acres of the water body, 32 sataks of the said water body has been vested with the Government. The report also speaks that the said water body is being enjoyed exclusively by the petitioners. The opposite party and the others have illegally tried to occupy the said water body by flooding

the same.

Having regard to the nature of the land and the dispute, the opinion of the Officer-in-charge of the Ghatal Police Station is that the embankment is water logged for most of the year due to the floods at Ghatal.

Having considered the submissions advanced and the report so submitted, I am of the opinion that if the petitioners have any grievance, they would approach the appropriate officer under the West Bengal Land Reforms Act, 1950 or the Department of Fisheries. The concerned officer will conduct an inspection, if he/she finds the accusation of the petitioners to be correct, he/she would inform the police station to take steps in accordance with the West Bengal Land Reforms Act, 1950 or other Special Acts.

With the aforesaid observations, WPA 8270 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record.
