Learned advocate appearing for the petitioner prays for bail as the petitioner is in custody from August, 2025. According to the petitioner charge sheet has already been submitted and the prosecution has relied upon 16 witnesses in order to prove its case. As such, the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized.

Having regard to the seizure in the present case, I am of the view, rigors of Section 37 of the NDPS Act is attracted.

Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over. Learned Trial Court would give priority to the examination of the seizure list witnesses.

At this stage, CRM (NDPS) 860 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
