This is an application under Section 482 of the Code of Criminal Procedure, 1973 filed by the accused petitioner for quashing of the proceeding being Case No.C-1645 of 1990 pending before the learned First Judicial Magistrate, Barrackpore under Section 14(1A) read with Section 14A(1) of the Employees Provident Fund and Miscellaneous Provisions Act, 1952.

The matter was taken up by the Coordinate Bench of this Court on 8th November, 1994 when the record was called for and in compliance thereof, the trial court record has been received by this Hon'ble Court.

It transpires from the record that an order of stay was granted vide order dated 8th November, 1994 until further order.

The matter is pending since 1994 and is running in the Warning List since 20.2.2025.

In view of the above facts and circumstances and considering the long pendency of the matter, this court finds no reason to keep the matter pending.

Accordingly, the matter being CRR 2252 of 1994 stands dismissed for default.

Let a copy of this order along with the trial court record be sent to the learned trial court for necessary information.
