Affidavit-of-service filed on behalf of the petitioner is taken on record.

Ms. Maiti, learned advocate representing the petitioner submits that petitioner has suffered punishment vide order dated 21st June, 2024 passed by the President, Ad-hoc Committee, West Bengal Board of Secondary Education on conclusion of disciplinary proceeding which was initiated against the petitioner. The president directed to withhold three annual increments of the petitioner.

Being aggrieved by said order of the President of the Board dated 21st June, 2024 an appeal was preferred before the Commissioner of School Education, West Bengal in terms of Rule 10 of the West Bengal Board of Secondary Education (Appointment, Confirmation, Conduct and Discipline of Teachers and

Non-Teaching staff) Rules, 2018. Appeal is required to be disposed of within ninety days from the date of its filing.

In the present case though appeal was filed in terms of Rule 10 on 25th September, 2024 but till date same has not been disposed of.

State respondents and Board are represented by learned advocates.

Commissioner of School Education, West Bengal being the appellate authority is directed to dispose of the appeal preferred by the petitioner by eight weeks from the date of communication of this order after granting due opportunity of hearing to the appellant and the disciplinary authority.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
