AD 9 May 7, 2025 Ct. 28 SG CRM(A) 1233 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj P.S. Case No.843/2024 dated 27.09.2024 under Sections 20(b)(ii)(c) of the NDPS Act.

Bharat @ Bhabesh Kumar Sarkar ... petitioner Mr. Arnab Chatterjee Mr. Sourav Mukherjee Ms. Poulami Bose Ms. Dhanasree Biswas ... for the petitioner Ms. Anasuya Sinha Ms. Sanjida Sultana ... for the State Learned counsel for the petitioner submits that apart from a statement of a co-accused, which is inadmissible in evidence, there is no material available against the petitioner. Learned counsel for the State relies on a report, which is taken on record and submits that there are criminal antecedents against the present petitioner. As many as five cases were registered against the present petitioner being Jalangi PS Case Nos.38/12 dated 13.01.2012, 41/2015 dated 10.01.2015, 420/13, dated 23.04.2013, Gurap PS Case No.135/19 dated 24.09.2019 and Kaliaganj PS Case No.32/23 dated 13.01.2023.

In view of the materials available in the case diary, the criminal antecedents of the petitioner and the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
