Learned counsel for the petitioner submits that the petitioner does not have the financial means to pay the quotation amount raised by the WBSEDCL for shifting the electricity line.

It appears from the inspection report filed by the WBSEDCL that a quotation amount of Rs. 28,265/- has been raised for the purpose of shifting the electricity connection as per the request of the petitioner from the petitioner's property.

The law is well-settled that in the event the petitioner seeks to have the overhead line removed to a different portion of his own premises or to a different level in the same premises, the costs may not have to be borne by the petitioner.

However, since the petitioner is seeking a shifting in the present case to a different property altogether, the costs are to be borne by the petitioner.

Since the petitioner submits that the petitioner is not agreeable to pay such shifting charges, the petitioner's prayer for shifting cannot be allowed. Accordingly, WPA 8277 of 2023 is dismissed without any order as to costs.

In the event the petitioner, within a fortnight from date, decides to gather such amount and pay the money, it will be open to the petitioner to apply afresh before the WBSEDCL for such transfer and if the fresh application is made within a fortnight from date, the WBSEDCL shall consider the same and take necessary steps accordingly. Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
