1. Learned Advocate appearing for the petitioners submits that the petitioners have been charged for offences under Section 14 (C)/14A(B) of the Foreigners Act on or about August, 2025 and is in custody for more than 8 months. Charge-sheet has already been submitted before the jurisdictional Court and as such they may be released on bail.

2. Learned Advocate for the State has produced the Case Diary.

3. I find that from the records that there are no seizure list or any document to substantiate that the present petitioners are from a neighbouring country. Petitioners were staying within the domain of Electronics Complex Police Station.

4. Without entering into the merits of the case and considering the period of detention of the present petitioners as well as the fact that the prosecution has relied upon 7 witnesses in order to prove its case and there is less possibility of the trial being taken to its logical conclusion within a reasonable period of time. I am inclined to release the petitioners on bail. As such prayer for bail is allowed.

1. Accordingly, Petitioners, namely, 1. Prasenjit Mondal @ Prosenjit Mondal 2. Subhasi Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Bidhannagar.

2. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Special Court. However, Petitioner no.1 namely Prasenjit Mondal @ Prosenjit Mondal would meet with the Officer-inCharge/Inspector-in-Charge of Electronics Complex Police Station or any officer deputed by him for a period of next six months until and unless the same is waived by the learned Court in seisin of the case.

3. Accordingly, CRM (R) 39 of 2026 is allowed.

4. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
