The grievance of the petitioners is directed against non-payment of compensation in respect of land which has been acquired by the State respondents.

It is submitted on behalf of the petitioners that notwithstanding the fact that the petitioners had made a representation to the Executive Engineer being the respondent no.4, there has been no consideration of the representation of the petitioners till date. Mr. Mondal appears for the State respondents and submits that he has no objection if the grievance of the petitioner be considered by the respondent no.4 herein in accordance with law.

In view of the submissions made on behalf of the parties, I direct the respondent no.4 to consider and dispose of the representation of the petitioners within a period of three months from the date of communication of this order after giving a right of hearing to all the affected parties.

I make it clear that I have not gone into the merits of the case and the respondent no. 4 in considering the representation of the petitioners will not be influenced by any observation or finding made in this order insofar as the merits of the case are to be considered.

With the aforesaid directions, WPA 9363 of 2021 stands disposed off.
