Learned counsel appearing on behalf of the petitioners submits as follows. The defacto complainant has made allegations of torturne for dowry demand and attempt to murder and the like against the other in laws. The petitioners are the brother in law and the sister in law. The husband is not an accused in this case. The allegation has been made after 14 years of marriage.
Learned counsel appearing on behalf of the State points to the statements of witnesses including that of the minor daughter of the victim recorded before a learned Magistrate.
In view of the materials available in the case diary and the fact that charge sheet has already been submitted, I do not think that custodial interrogation of the petitioner is required in this case. . In view thereof, the prayer for anticipatory bail is allowed.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not try to influence the witnesses or threaten them. The petitioner no.1 shall stay beyond the jurisdiction of Kaliganj Police Station for a period of six months from this date, except for attending Court or meeting the Investigating Officer.
The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
