Petitioner seeks bail.

Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 85 days. The police submitted charge sheet and, therefore, further detention of the petitioner is not required. He submits that there is no evidence of complicity of the petitioner in the incident. Learned Additional Public Prosecutor draws the attention of the Court to the statement of an eye-witness recorded under Section 164 of the Code of Criminal Procedure. He submits that apart from the petitioner, the others were implicated. Considering the statement of the eye-witness recorded under Section 164 of the Code of Criminal Procedure and

considering the gravity of the offences and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

C.R.M. (DB) 1178 of 2022 is dismissed.
