22.04.2025 Court No.28 Item No.32 ssi CRM (A) 1238 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Baishnabnagar PS Case No.1011 of 2024 dated 22.09.2024 under Sections 21( c)/27A/29 of the NDPS Act.

And In the matter of: Rafik Ali @ Rafikul @ Tofajul @ Tafu Sk ....Applicant/Petitioner.

Ms. Sabrina Parvin ...for the petitioner.

Ms. Amita Gaur Ms. Snigdha Saha ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. About 400 grams of brown sugar was recovered from the co-accused. The only material available against the petitioner is the statement of a co-accused. Charge sheet has been submitted.

Learned counsel appearing on behalf of the State submits as follows. Apart from the co-accused's statement, there is CDR analysis of the phone call records of the petitioner and the accused. It appears that at the relevant time, there were calls made between them. That apart, a photocopy of the petitioner's Aadhar Card (photocopy) was seized from a place in Ranchi pursuant to a statement made by the said co-accused. In view of the incriminating materials appearing against the petitioner as well as the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
