The petitioner is aggrieved by the fact that his representation dated 17.02.2023 was not acted upon by the Inspector-in-Charge, Baruipur Police Station. Petitioner complains that some miscreants were trying to forcefully occupy his land and to that extent have been threatening him and his family members. In spite of information to the police authorities, no steps have been taken.

State has submitted a report which reflects that at the relevant point of time, police authorities drew up proceedings under Sections 107/116 of the Code of Criminal Procedure. According to the police authorities, the nature of the dispute had flavour of civil dispute. As such, the police authorities did not interfere in the dispute.

Considering the fact that there were allegations of threat of dire consequences and tremendous pressure being created at the behest of certain local miscreants, I am of the view that if the petitioner still faces the same inconvenience, the petitioner would be at liberty to approach the Inspector-in-Charge, Baruipur Police Station who would take steps in accordance with law.

With the aforesaid observations, the writ petition being WPA 8289 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
