Learned advocate appearing for the petitioners prays for expediting the trial arising out of Thakurpukur P. S. Case No. 112 of 2019. According to the learned advocate chargesheet was submitted in the year 2019 and after supply of documents till date the case is pending before the learned Judicial Magistrate, 2nd court, Alipore, South 24 Parganas.
Petitioners have preferred an application for discharge which is also pending.
Having regard to the time period which has passed, I direct that the learned trial court on the next date so fixed or within a month thereafter would dispose of the application for discharge which has been preferred at the instance of the petitioners. No further adjournments be granted to any of the parties. If after considering the application for discharge, the learned trial court is of the opinion that the charges are to be framed then the trial court would within a fortnight after passing of
the order in the said application fix date for framing of charge. The learned trial court would keep in mind that the case was initiated almost five years ago and would fix at least one date in every sixty days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. It is directed that the trial of the case would continue in spite of the resolution of the local bar and the learned participating/representing advocate will not stall the proceedings because of any such resolution.
With the aforesaid observations, the present revisional application being CRR 1319 of 2024 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
