This is an application for bail in connection with New Town Police Station Case No. 498 of 2015 for committing offence punishable under Sections 363/365 and adding Sections 302/201 of the Indian Penal Code at the behest of the petitioner.

The petitioner is in custody since last 5 years and 7 months in connection with the instant case and the application for bail was rejected on an earlier occasion. In course of hearing, it transpires that the trial has seen a substantial progress as all witnesses excepting the Investigating Officer is yet to be examined.

Since the earlier application for bail filed by the petitioner was rejected and we do not find any changed circumstances, the prayer for bail of the petitioner is rejected. However, we direct the learned Sessions Judge to fix a date for recording of the evidence of the Investigating Officer, which shall not be beyond three weeks from the date of the communication of this order and efforts may be shown to bring the case to its logical end at an earliest.

The application for bail being CRM 3239 of 2021 is disposed of.
