Petitioner has made an application for transfer from Primary School in Jhargram to a Primary School in Paschim Medinipur and such application was made on 25th March, 2025 before the Secretary, West Bengal Board of Primary Education. It is submitted by the learned advocate representing the petitioner that petitioner has completed five years of confirmed service as primary teacher and the reason for seeking transfer is distance in between the

present school of the petitioner and her place of residence. It is also stated in the transfer application that petitioner is a surplus teacher in the present school.

State respondents, concerned District Primary School Councils and West Bengal Board of Primary Education are represented by learned advocates.

Since petitioner has prayed for transfer from one district to another and has completed five years of continuous service issue needs to be decided by the Secretary, West Bengal Board of Primary Education.

Secretary, West Bengal Board of Primary Education being respondent no. 4 is directed to decide the transfer application of the petitioner dated 25th March, 2025 in accordance with law by (eight) weeks from the date of communication of this order and decision to be taken by the respondent no. 4 shall be communicated to the petitioner by fortnight thereafter.

It is made clear that suspension of portal shall not be ground to reject transfer application of the petitioner.

Writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
