Report on behalf of the State containing a further statement of the victim/de facto complainant, as filed in Court, is taken on record. Learned counsels appearing on behalf of the accused petitioners and the de facto complainant/wife submit that the dispute that had led to the registration of the instant FIR have all being finally settled and compromised between the private parties. The de facto complainant does not want to proceed with the criminal case.

Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. There is no injury report available in the case diary. The de facto complainant has subsequently written a letter and then had a statement recorded that the matter has been settled and she did not want to pursue the same.

In view of the settlement arrived at between the private parties and in the interest of justice, I quash the impugned proceeding in respect of ACGR Case No.5293/ 2017 pending before the learned Judicial Magistrate, 9th Court, Alipore arising out of Patuli Women Police Station Case No.7 dated 28.10.2017.

Accordingly, the revisional application and the connected application are disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
