By this public interest writ petition, the petitioner seeks for issuance of a writ of quo warranto stating that one Dr. Gautam Bandyopadhyay, who is presently the principal of the 10th respondent / college is not competent to hold the post. The allegations are made against the said person alleging that he cannot be engaged in the said post beyond the age of 65 years.

We find from the cause title that Dr.

Gautam Bandyopadhyay has not been impleaded as a respondent. Therefore, we permit the writ petitioner to withdraw this writ petition and file an appropriate writ petition impleading the proper parties and the petitioner will be entitled to raise all contentions in the fresh writ petition.

With the above observation, the writ petition is dismissed.

There shall be no order as to costs.
