The limited grievance of the petitioner is that the matrimonial suit pending between the parties is pending unnecessarily for mediation over a prolonged period. In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

Although there is no scope of directing the trial court to dispose of the suit expeditiously at the present juncture in view of the pendency of the matter before a Mediator, the Additional District Judge, Third Court at Barasat, District-North 24 Parganas, is requested to dispose of Matrimonial Suit No.831 of 2018 pending before it, along with connected applications and other proceedings, as expeditiously as possible after the matter returns from mediation, in the event of failure of such mediation, preferably within six months from such return of the file.

It is expected that the Mediator will take appropriate steps for expeditiously disposing of the proceeding for mediation pending before the said Mediator.

Liberty is given to the learned advocate for the petitioner to communicate this order to the Mediator as well as to the court below and the opposite party and/or his advocate in the court below, along with server copies of this order, to ensure due compliance of the same. In the event such communication is made, both parties, the trial court, as well as the Mediator shall act upon the same without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent website certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
