Petitioner being an assistant teacher retired on superannuation on 31st December, 2023 and thereafter was paid retiral dues including provident fund. Grievance of the petitioner is payment of less amount towards provident fund which trigerred the present writ petition. It is submitted that there were requirements to submit certain documents as sought for by the school authority and based on the request made by the school authority petitioner deposited those documents before the school authority. It is further submitted that in spite of taking steps on the request of the said school authority till date due provident fund amount has not been cleared.

State respondents are represented by learned advocate.

Having considered the respective submissions made on behalf of the parties writ petition stands disposed of directing the District Inspector of Schools (SE) Jhargram being respondent no. 3 to decide the claim of the petitioner seeking release of unpaid provident fund dues by 8 (eight) weeks from the date of communication of this order after granting opportunity of hearing to the petitioner and the school authority or their representatives.

Respondent no. 3 shall pass a reasoned decision within the aforesaid time and communicate the same to the parties by 10 days thereafter.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
