1. Report along with annexure forwarded by the Block Development Officer, Farakka, Murshidabad signed on 29th January, 2025 is taken on record.

2. From the report it appears that, as per the official records there are two cook-cum-helpers working in the institution and all payments relating to cooking and serving are included in the honorarium of the cook-cum-helpers and payment is regularly disbursed. There is no due upto December, 2024.

3. The report further mentions that, the petitioner has been reported to be involved in various defalcation cases.

4. The primary allegation of the petitioner in the writ petition was that because of non disbursal of fund, the Mid Day Meal project could not be run properly, but the report of the Block Development Officer speaks otherwise.

5. Despite being the Headmaster of the institution, if the Block Development Officer finds the petitioner to be unfit for disbursal of funds, then it will be open for the Block

Development Officer to initiate appropriate proceeding against the delinquent person, in accordance with law.

6. The instant writ petition is disposed of by directing the Block Development Officer, Farakka, Murshidabad to ensure that the Mid Day Meal project runs in proper manner and funds are made available for the same on regular basis.

7. The writ petition stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
