No. 29 KAUSHIK REJECTED C.R.M.(A) 1485 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Gangnapur Police Station Case No. 455 of 2022 dated 07.09.2022 under Sections 363/365/376(D)/379/506/34 of the Indian Penal Code, 1860.

And In Re : Amit Biswas @ Mondal ...... petitioner Mr. Debasis Kar Mr. Arka Tilak Bhaduri ....for the petitioner Mr. Arijit Ganguly Mr. Koushik Kundu ....for the State Complicity of the petitioner transpires from the statement of the victim recorded under Section 164 of the Code of Criminal Procedure.

Apparently, the petitioner was instrumental in kidnapping the victim.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1485 of 2023 is dismissed.
