Saha ... for the Petitioner(s) Mr. Avishek Sinha Mr. Asif Dewan ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was arrested on 3rd November, 2026 and since then he is in custody. Learned advocate added that the subject-matter of the present case is alleged recovery of 1050 bottles of cough syrup and charge has already been framed, as such, further detention of the present petitioner is unwarranted.

Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that the interception was at the border by the BSF officials and the re-seizure by the police authorities.

Having considered that the seizure was made at the sensitive zone, I am not inclined to enlarge the petitioner on bail at this stage.

Hence, the prayer for bail of the petitioner is Rejected.

However, the petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. As next date has been fixed on 11th May, 2026 the learned trial court/special court is directed that within 60 days from the aforesaid date, the evidence of the seizure list witnesses be completed. The petitioner would be at liberty to approach this court after the aforesaid time period is over.

Accordingly, CRM (NDPS) 682 of 2026 is Dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
