Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee Mr. Soumik Dey Mr. Saikat Pal ..for the petitioner Mr. Sujit Sankar Koley ..for WBSEDCL The petitioner seeks electricity connection for his submersible pump set.

Pursuant to the order dated April 24, 2025, an inspection was conducted.

Learned counsel appearing for WBSEDCL submits that though the petitioner was present at the time of inspection, he refused to sign the inspection report. Learned counsel appearing on behalf of the petitioner denies the allegation.

From the inspection report, it appears that way-leave is required at least from eight persons in the adjoining locality.

Learned counsel appearing for the petitioner disputes the content of the report.

I am of the view that the nature of dispute as involved in this writ petition cannot be decided by this Court.

Accordingly, I grant liberty upon the petitioner to file an application before the concerned District Magistrate in accordance with Rule 3(b) of the Works of Licensees Rules, 2006.

If any such application is filed before the District Magistrate, the same shall be decided by the District Magistrate as expeditiously as possible after giving an opportunity of hearing to all concerned.

Accordingly, WPA 8337 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
