The petitioner is a retired school teacher. He was placed under suspension as he was in custody for more than 48 hours in connection with a criminal case. During the period of suspension he retired from service.

After completion of his conviction period, the petitioner applied before the District Inspector of Schools for releasing his terminal dues.

The District Inspector of Schools, Primary Education, Purulia vide communicating memo dated 359/1(3) dated 29th April, 2022 passed reasoned order by directing that the petitioner would be entitled to receive his terminal dues. The petitioner has received GPF amount and GSLI amount. The Pension Payment Order has also been issued in his favour and he is receiving pension.

The petitioner alleges that he is yet to receive the subsistence allowance with interest for the period 20th April, 2010 to 31st January, 2015, his balance gratuity amount and the interest on account of delayed payment of pension.

He made representation before the District Inspector of Schools and the Chairman, District Primary School Council, Purulia on 26th February, 2024. The said representation is pending consideration till date.

Without going into the merit of the said representation, the instant writ petition is disposed of by directing the District Inspector of Schools (Primary), Purulia to consider and dispose of the prayer of the petitioner as highlighted in his representation dated 26th February, 2024 in accordance with law at the earliest positively within a period of sixty days from the date of communication of this order. A reasoned order

shall be passed and communicated to the petitioner immediately.

All necessary consequential steps shall be taken by the aforesaid respondent immediately thereafter. Learned advocate for the petitioner is directed to forward a copy of the representation dated 26th February, 2024 along with all documents in support of his prayer to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
