Petitioner made application for transfer on 18th March, 2025 from one primary school to another in the District of Malda. It is submitted by learned advocate for the petitioner that petitioner is divorcee and divorce decree was passed on 5th August, 2023 as a result whereof being single mother petitioner is facing difficulty in attending the school which situates 35 kilometers away from her place of residence. It is also submitted that petitioner has completed 5 years of confirmed service as primary teacher,

she was initially appointed on 15th February, 2017.

State respondents and District Primary School Council, Malda are represented by learned advocates.

Chairman, District Primary School Council, Malda being respondent no. 4 is directed to take decision on transfer application of the petitioner dated 18th March, 2025 by 4 (four) weeks from the date of communication of this order and the decision to be taken by respondent no. 4 shall be communicated to the petitioner by 10 days thereafter.

Transfer application of the petitioner shall not be rejected due to suspension of portal.

Writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
