Mr. Sayan Dey, learned Advocate appearing on behalf of the respondent nos. 2 and 3 at the very outset draws attention of this Court dated 16.09.2025 as passed by this Court in connection with the instant writ petition. 2.

It is submitted by Mr. Dey that since on the last occasion that is on 16.09.2025 he was busy in another Court he could not appear before this Court on behalf of the respondent nos. 2 and 3 as a result whereof this Court requested Ms. Monika Roy to appear on behalf of the respondent nos. 2 and 3 with a further direction upon the respondent nos. 2 and 3 to regularize the appointment of Ms. Monika Roy.

It is submitted by Mr. Dey that since he has filed his vakalatnama in connection with the instant writ petition on behalf of the respondent nos. 2 and 3, his vakalatnama may be retained and he may be allowed to do the case on behalf of the respondent nos. 2 and 3 instead of Ms. Monika Roy.

In view of such, the earlier order dated 16.09.2025 is modified to the extent that Mr. Sayan Dey, learned Advocate is permitted to argue in connection with the instant writ petition on behalf of the respondent nos. 2 and 3 pursuant to filing of valakatnama by him on behalf of his clients.

Accordingly, the respondent nos. 2 and 3 are directed not to execute any vakalatnama in favour of Ms. Monika Roy in connection with the instant writ petition as directed by this Court vide order dated 16.09.2025. 6.

At the time of hearing, learned Advocate appearing on behalf of the writ petitioner submits before this Court that on account of some technical defect the writ petitioner intends to withdraw the instant writ petition with a liberty to file afresh on the self-same cause of action.

In view of such, WPA 8339 of 2025 stands hereby withdrawn and is thus disposed of.

Liberty is given to the writ petitioner to file similar such application based on self-same cause of action, if so advised.
