Mr. Debasis Kar Mr. Subhojit Roy Chowdhury Mr. Arka Bhadra .....for the petitioner Mr. Imran Ali Mrs. Debjani Sahu .....for the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 376 and 417 of the Penal Code. Let a copy of this application be served Mr. Imran Ali and Mrs. Debjani Sahu, learned counsels, who are present in Court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. The FIR was lodged on 23.02.2017. The petitioner was first arrested and thereafter granted bail. Charge sheet was submitted on 30.04.2017. 10 witnesses are proposed to be examined as per the charge sheet. A date was fixed for framing of charge on 20.02.2019. Yet, till date even charges could not be framed. The matter has remained pending for no fault of the present petitioner.

Learned counsel for the State submits that the State would not come in the way if a direction is passed to

expedite the trial.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.

It appears that some delay has been occasioned in this case, especially considering the fact that since 20.02.2019 the issue of framing of charge has remained pending. In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible and in particular, to decide the question of framing of charge at the earliest after hearing the necessary parties, preferably on the next date fixed for hearing or within three months from the said date. With these observations, the revisional application is disposed of.
