Civil Revisional Jurisdiction Subrata Bhattacharyya AR(C) CO No.1285 of 2025 Sri Santosh Kumar Chowrasia -vsSri Ram Kumar Mishra Mr. Arjun Basu ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division) 2nd Court at Howrah to dispose of Title Suit No. 195 of 2019 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon learned advocate representing the opposite party before the learned trial judge.

Learned advocate for the petitioner submits that hearing of an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 and an application under Order XXXIX Rule 7 CPC was fixed for hearing on April 10, 2025, but that hearing of such applications stood adjourned to July 29, 2025.

In the light of the submission made on behalf of the petitioner, CO No.1285 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court at Howrah to take up the interim applications - one under Order XXXIX Rules 1 and 2 CPC and the other

under Order XXXIX Rule 7 CPC - on the next date fixed for hearing (i.e. on July 29, 2025), if the same is ready for hearing, and to dispose of the same as expeditiously as possible, without granting unnecessary adjournments to either of the parties.

Certified copy of this order, if applied for, shall be made available to the parties.
