1. The prayer of the petitioner for grant of interest on account of delayed payment of his terminal dues and for non-releasing of his leave encashment is pending consideration before the Member Secretary, West Bengal Pollution Control Board.

2. The petitioner retired from service on 31st January, 2010. His terminal dues have been released long thereafter. The petitioner prays for interest.

3. None represents the West Bengal Pollution Control Board despite service. Affidavit of service filed in Court today is taken on record.

4. As it appears that the prayer of the petitioner for grant of interest is pending consideration at the end of the respondent Board, no useful purpose will be served by keeping the writ petition pending.

5. The instant writ petition stands disposed of by directing the Member Secretary, West Bengal Pollution Control Board being

the respondent no. 2 herein to take a decision on the petitioner's prayer strictly in accordance with the prevailing Rules at the earliest but positively within a period of six weeks from the date of communication of this order.

6. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

7. If the prayer of the petitioner is allowed, then necessary consequential steps shall taken for releasing the payment in favour of the petitioner without any further delay.

8. Learned advocate for the petitioner is directed to forward a copy of the subject representation along with all other supporting documents to the aforesaid respondent at the time of communicating the order of this Court.

9. The writ petition stands disposed of.

10. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
