Mr. Kazi Sajjad Alam ..... for the petitioner The petitioner is serving as a Teacher of Madrasah. Court No. 24 04.04.2022 (Item No. 23) (AB) He made a prayer before the Additional District Inspector of Schools (SE) that he is getting the scale of pay equivalent to his Kamil qualification but he is entitled to scale of pay as per the MM qualification.

The petitioner relies upon notification dated 30th January, 2009 published by the Minority Affairs and Madrasah Education Department wherein the scale of pay for teachers in accordance with their respective qualifications has been mentioned.

The grievance of the petitioner is that his representation dated 23rd March, 2021 is pending consideration till date.

None appears to oppose the prayer of the petitioner despite service.

Affidavit of service filed in Court is taken on record. In view of the above, the instant writ petition is disposed of by directing the respondent No. 4 being the Additional District Inspector of Schools, (Secondary Education), Arambag to take a decision with regard to the

prayer of the petitioner for payment of higher scale of pay strictly in accordance with the relevant rules/circulars/notifications at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner is directed to forward a copy of all testimonials in support of his educational qualification to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
